NOTICE
TO TOWN OF FOND DU LAC PROPERTY OWNERS

A recent change in the Farmland Preservation law will require changes
in the Town’s Zoning and Mapping.  The Town is working with Attorney
Matt Parmentier to assist the Town in implementing these changes. 
These new rules will mainly affect owners who have land that is zoned
exclusively agricultural, AG.

On August 3, 2010 at 7:00 pm a meeting will be held at the Town Hall,
W5990 Pioneer Road, to explain the new Farmland Preservation Law and
to help determine if a zoning change is needed for resident’s
property.

One reason a property owner might wish to stay zoned AG is to continue
to be eligible for tax credits.  The new law also allows farmers zoned
AG to create up to 4 non-farm residential lots without having to
rezone the land or amend the Town’s Comprehensive Plan.  The new law
would only require a conditional use permit, as long as one owns  -20
acres of farm land for every acre of non-farm residential property.  

Another change in the Farmland Preservation Law is the conversion fee.
 This fee will have to be paid any time land is rezoned from AG to
another zoning district.  This fee is 3 times the value of the Class 1
farmland in the Town..  At this time the current value of Class 1
farmland is $229.00 per acre.  This means a conversion fee of $687.00
per acre would be paid at the time the property is rezoned.  This
money is collected by the Town and must be turned over to the State. 


It is in the best interest of the residents, especially those
properties zoned AG, to attend the August meeting to obtain
information about the Farmland Preservation Law and discuss the zoning
of their properties.  The Town will have a one-time opportunity to
rezone AG property without triggering the conversion fee.  Final
zoning decisions are up to the Town Board, but the Board is most
interested in learning the preferences of residents.  Therefore, it is
in your best interest to attend the meeting.

In addition to the August meeting, once the maps have been updated, a
meeting will be held so residents have one last chance to discuss
changes to their property zoning..  After this meeting, a Public
Hearing will be held to adopt the new zoning maps and submit them to
the State for approval.

IT IS IMPERATIVE THAT THOSE WITH AG AND AT ZONED PROPERTIES ATTEND THE
AUGUST 3 MEETING.
