TOWN OF FOND DU LAC FOND DU LAC COUNTY MONTHLY MEETING AUGUST 12, 2013 7:00 PM The August Monthly Meeting was called to order by Chairman Harold Manske. Present were Chairman Manske, Supervisors LeRoy Schmitz and Phyllis Giese, Clerk Patti Supple, Treasurer Jody Roffers, Attorney Matt Parmentier and various Town residents. Confirmation was made of open meeting notice. Minutes from the previous meeting were approved as presented. There were no public comments Code Enforcement Officer Jim Supple reported that Attorney John St. Peter had sent a letter to Mr. Majerus concerning the culvert on his property on Westview Drive. No reply has been received, and the culvert has not been repaired. A final letter will be sent by Attorney St. Peter stating the culvert must be repaired or the Town will do the repair and charge it to the Majerus tax bill. Letters were sent to Westfield Hideaway vacant property owners and to Roger Koehler about weed cutting. All properties have had the weeds cut. Letters were sent to mobile home property owners in Woodland Mobil Home Park concerning roof damage. (W6355 and W6357 Oakwood) The work has been done on these properties. A mobile home on N7124 Spruce Drive has a tarp covering roof damage. Locating the property owner has been unsuccessful, so Barb Hillman the Park owner will be notified about the damage and she will be required to repair or remove the home. David Zimmerman has corrected the drainage problem on his property and paid the engineering fees. The water system update from Kaempfer was reviewed. The DNR has approved the water chlorination project. In an earlier meeting with Hometown Bank concerning the Esterbrook Estates Addition 1 road upgrades, it was recommended that Gremmer Engineering evaluate the road conditions and make recommendations on upgrading needed to meet Town standards. Gremmer evaluated the road and a meeting will be scheduled to review the recommendations with Hometown Bank. At the earlier meeting, Hometown officials asked if the Town would be willing to contract the work with the County and charge back the fees to the Bank. A reimbursement agreement would be required if this option is taken. The Certified Survey Map for Fondy Investments was reviewed. It was noted a road bond would be required for the extension of Streblow Drive as well as a development agreement. Supervisor Schmitz expressed concern over the temporary cul-de-sac and the future development of Lot 4. Motion was made and seconded to approve the CSM for Fondy Investments, LLC contingent on a road bond and development agreement addressing the town road standards, stormwater infrastructure and utility construction. Motion carried. The Certified Survey Map for Esterbrook Cemetery was reviewed. Clerk Supple noted that Lot 2 has an easement onto Esterbrook Road, and Lot 1 will be combined into one lot with the property buyer on Scott Street, thus creating an easement. There is also an easement onto this lot through cemetery property off Scott Street. Motion was made and seconded to approve the Esterbrook Cemetery CSM. Motion carried. The Preliminary Plans for Harris & Associates were reviewed. The Planning Committee recommended approval of the Plan contingent on stormwater management plans, an approved development agreement, utility plans, and a copy of the lease agreement being provided. Motion was made and seconded to approve the preliminary plans contingent on the above recommendations being met. Motion carried. Concern was raised over traffic flow and turn lanes being established. Chairman Manske noted the DOT is responsible for studies in this area with the reconstruction of Hwy 23. Motion was made and seconded to approve the contract with /the County to reconstruct Forest Avenue Road from CTH T to the Airport at a cost of $169,041.99. Motion carried. The Snowplowing maintenance agreement with Fond du Lac County Highway Department was reviewed. After the recommended changes from Attorney St. Peter were added, motion was made and seconded to approve the agreement. Motion carried. The topic for the Stormwater this month is “Fish don’t swim in chlorine”. Supervisor Schmitz attended the Hwy meetings. He noted the County stated there would be no second access onto Pioneer Road by the Town Hall. The finish date for the Pioneer Road construction is November 8, 2013. Chairman Manske will attend the OSG meeting and the next boundary agreement meeting. The application from the owners of Top Stick Bar for a liquor license was reviewed. After review motion was made and seconded to approve the application after the submission of sellers permit numbers. Motion carried. Motion was made and seconded to approve the operator’s licenses for Jesusita Deleon from Engies and Yvonne Cheevers and Christine Babler from AJ’s. Motion carried. There are no Board of Appeals meetings planned. The Planning Commission will be reviewing the Final plans for Harris & Associates apartment complex plans, Fondy Investments plans and Rusniacek plans. No dates have been set for any of the meetings as yet. The Farmland Preservation ordinance and maps will be reviewed. A letter was sent by the County to some residents of Terrace Road concerning the replacement of gas probes on their properties. The newest population estimate has the Town at 3381 residents.
