MONTHLY MEETING
APRIL 9, 2012
7:00 PM

The Monthly Meeting was called to order by Chairman Harold Manske. 
Present were Chairman Manske, Supervisors Phyllis Giese and LeRoy
Schmitz, Clerk Patti Supple, Treasurer Jody Roffers, Attorney Matt
Parmentier and various Town residents.  Confirmation was made of open
meeting notice.  Minutes from the previous meeting were approved as
presented.

Newly elected County Supervisor Mike Gannon thanked the residents for
their support in the last election.  He stated he hopes to be
reappointed to the Highway Commission.

Attorney Parmentier noted that the State of Wisconsin/Public Service
Commission will be reviewing the Wind Energy and Solar Energy
regulations.  He stated until the State finalizes their rulings, the
Town should wait to adopt any ordinances pertaining to wind and solar
energy.

Chairman Manske reported he has had a report of a dog barking on
Canterbury Drive and that there is a family in Esterbrook Road that is
raising chickens.  Both matters were turned over to Code Enforcement.

Jason Johnson from Veolia presented an addendum to the present
contract with the Town of Fond du Lac.  He offered three options with
varying degrees of savings.  After review, the Town opted to accept
the 10 year renewal starting at $12.93 per unit-with $10.09 for solid
waste and $2.84 for recycling.  All other terms of the contract will
remain in effect.  Motion was made and seconded to approve the ten
year contract renewal with the above rates and the approval of the
Town Attorney on the contract addendum.  Motion carried.

Jen Pfeiffer of Canterbury Drive was present to discuss drainage
issues.  Chairman Manske reported that the proposal to install a
pumping system was turned over to Engineer Ron Cunzenheim for
clarification and recommendation.  A copy of his recommendations was
forwarded to the Board and Jen Pfeiffer along with a cover letter from
Attorney John St. Peter.  Ms. Pfeiffer stated that the recalibration
of sump pumps reported in the Attorney’s letter was not done. 
Chairman Manske reported that in talks with the Village of North Fond
du Lac over testing for potable water infiltration, it was reported
that several sump pumps were recalibrated.  The following
concerns/comments were expressed by property owners:
1.	There is an infiltration of ground water in the area and that when
the sewer lines were installed, the gravel base caused water to flow
into residents homes.
2.	Clay barriers were not installed.
3.	The ditches are not being maintained and are weedy.
4.	The subdivision was built in a wetland area with springs.  The Town
should not have allowed construction and approval of the subdivision
with the water issues
5.	The present pump is not working correctly.  (Also, why was the pump
installed.)
6.	The recently installed drainage tiles have a cover that is not
properly installed.
7.	DNR has given approval for the installation of another pump to help
drain water from the area of the sewer lines.
8.	Can’t sell houses due to the water issues and can’t take vacations
for fear of a sump pump malfunction.
9.	Residents would like another Engineer’s opinion.

The Board’s response to the above:
1.	Clay barriers were installed by the contractors on some homes.  The
sewer lines were constructed years ago, and the water infiltration is
more recent.
2.	Ditches should be maintained by property owners.  Some longer grass
on Town property is for water filtration.  The County will be siting
the area from Canterbury to Forest Avenue during the construction on
County T and Forest Avenue Road.
3.	The Town Board had no knowledge of springs or wetland in the
subdivision.  All water issues were addressed by the site and drainage
plans presented in the Preliminary and Final Plats of the subdivision.
 The Engineer on the project assured the Town that the plans addressed
any water issues.
4.	The present pump is owned and must be maintained by the property
owners per the Development Agreement and Covenants of the subdivision.
 The pump was installed by the Developer to drain the retention ponds
in the event of overflow.  Before the Agreements were read, Chairman
Manske contacted Town & Country Construction to look at the pump and
determine the problems.  Diggers hot line and the phone company were
notified of potential work in the area.  The pot hole will be filled
in as soon as the phone company gives approval.  It is now up to the
residents to handle the repair of the pump.
5.	Pat Mand’s recommendation on the second pump cannot be done by the
Town due to potential contamination from the sewer lines if a break
occurs.  Residents should consider installation on private property
rather than Town property.
6.	The recently installed drainage tiles should have been done by the
subdivision residents, not the Town.  The Board is still considering
how to proceed with correction of the cover and who will cover the
cost.
7.	Residents are welcome to hire another engineer at their expense.
8.	The Town must prioritize projects-there are budget constraints.

This matter will be on the agenda for May.

The status report for the Water Utility was reviewed.  The broken gate
valve is being sent to an independent company for testing.

Motion was made and seconded to release the Letter of Credit to BASCO,
LLC.  Motion carried.

Due to the fact the Annual Meetings will be held one week later per
State mandate, motion was made and seconded to extend the Town
Officials terms by one week.  Motion carried.

It has come to the attention of the Town Board that when residents pay
their taxes with escrow checks, the amounts can be significantly more
than the tax due.  Recently, one of the checks was cancelled before it
could be cashed by the Treasurer.  This could have caused a loss to
the Town.  Therefore, motion was made and seconded to approve a
Resolution regulating the return of overpayments to residents.  Any
refunds over $150.00 will be held until the check clears the bank. 
Motion carried.

Scott Roltgen of Emery Lane was present to request the Town put the
final layer on the road.  He stated that the Martin’s had a $30,000.00
letter of credit to help defray costs.  He added that a binder course
was laid with the intention of finishing the road when 75% of the lots
were built upon.  The subdivision is filled now, and the road is
breaking up.  Therefore, the homeowners would like the Town to take
over the road and complete construction.  Chairman Manske stated the
owners never approached to Town Board to takeover the road and that
Anna Mae Martin died before the subdivision was completed.  Supervisor
Schmitz advised treating Emery Lane the same way as Terrace Road. 
This road was completed by the Town and the residents paid for the
construction over a ten year period on a B-bond.  Chairman Manske
stated he will get an estimate from the County for miling the road,
installing 4” of asphalt and doing some re-ditching.  Mr. Roltgen
objected to the property owners being responsible for the
construction.  Chairman Manske stated that until the road is taken
over by the Town, at the owners /developers request, the road remains
a private entity.  Attorney Parmentier stated he will discuss with
Attorney Rosenfeldt the possibility of money remaining in the Anna Mae
Martin trust.  The matter will be on the May agenda.  (The matter was
brought up that the Town plows the road, but this is a matter for
emergency protection per ambulance and fire trucks.  This does not
make the Town responsible for the road.  Larry Kaatz stated that when
he purchased his lot he was informed that Signature Homes would be
repaving the road when the last house was built.)

The MS-4 was submitted in March.  The subject for Stormwater
Management for the month is the NEWSC Spring Newsletter.

Supervisor Schmitz attended the County Highway meeting.  Chairman
Manske reported that Kaempfer is doing some locates on Esterbrook Road
for the County construction plans.  In addition he attended the
ambulance meeting.  He noted the Village’s Emergency Management/Fire
Chief has resigned.  

The Planning Committee will be meeting to discuss the Solar and Wind
energy ordinances.  Shooting in subdivisions will also be addressed. 
There are no meetings planned for the Board of Appeals.
Fire Chief Craig Sanborn noted that there was a picture in the
Reporter of two Town poll workers.  Clerk Supple noted that the Town
poll workers do an excellent job and should be commended for their
dedication.  She also noted that elections will be held on May 8th and
June 5th for the recall elections.  Supervisor Giese reported that
some fire number signs on Garden Drive need to be moved to the correct
location per County guidelines.
Clerk Supple noted that in a letter from the DOT, the DOT will not
decrease the speed limit on Highway 23 from Townline Road to Highway
41.  She also noted that a CSM was submitted by O’Laire too late to be
on the agenda.  It was recommended that Sam Tobias be contacted for
clarification of the CSM before the May meeting.
