January 8, 2007 Monthly Meeting
TOWN OF FOND DU LAC FOND DU LAC COUNTY MONTHLY MEETING JANUARY 8, 2007 7:00 PM The Monthly Meeting of the Town Board was called to order by Chairman Harold Manske. Present were Chairman Manske, Supervisors Phyllis Giese and LeRoy Schmitz, Clerk Patti Supple, Treasurer Mel Buechel, Attorney John St. Peter, and various Town residents. Confirmation was made of open meeting notice. Minutes from the previous meeting were amended to include Loretta Koenigs as a poll worker. Minutes were then approved. There were no public comments. Attorney St. Peter presented the resolution concerning the Esterbrook Estates disputed issues dated January 8, 2007. Among the disputed issues are the earthen stockpiles, existing roads in the original Esterbrook Estates, the ditching/culvert rehab, sewer connection fees, and several changes to the declaration of restrictions for Esterbrook Estates Addition 1. The disputed issues were discussed with the following recommendations being added: included in the sewer connection fee area, the Town’s review and consent of the contractor used for the project using the same standards as for the Town project, and concerning the ditching/culvert rehab a more firm cost estimate. Chairman Manske noted that the lines should be televised before the Town takes over jurisdiction of the project and that all warranties be assigned to the Town upon completion and acceptance by the Town. It was noted that the earthen stockpiles will need silt fencing to control erosion. Attorney Sam Kaufman will finalize the resolution with the recommended changes for approval and signing at the January 22, 2007 Town Board Meeting. The Town Board next reviewed the September 2005 Board minutes. The issue is before the Board because the 2005 minutes contained a statement that “. . . no more driveways will be allowed to front on Martin Road.” There was discussion among Board members on whether this was consistent with the intent of the 2005 resolution. There followed extensive discussion on whether the above clause intended to apply to that portion of the Supple property that was being rezoned, all of the Supple property or all property along Martin Road whether owned by the Supples or other parties. Further complicating the discussion is a pending sale of 2 acres by the Supples to individuals intending to construct a residence with access to Martin Road. After further discussion, motion Manske second Giese with unanimous approval of the following resolution: RESOLVED, that only 2 access points will be allowed onto Martin Road for that portion of the Supple-owned land that was rezoned in 2005: one access point for a 2-acre parcel that is intended to be sold by the Supples to a third party and another access point for the road that will provide ingress and egress to the further internal subdivision of that portion of the Supple-owned land that was rezoned in 2005. FURTHER RESOLVED, that the above resolution shall only apply to that portion of the Supple-owned land that was rezoned in 2005. The location and extent of access onto Martin Road for all other land, whether owned by the Supples or other individuals, is subject to a case-by-case determination. The Water Tower update was provided. The main concern at this time is the financing of the project and the contract with North Fond du Lac. Supervisor Schmitz noted that there is a possibility of income from cell phone antenna being attached to the tower. Kay Marshel was sent a check and paperwork to sign concerning the purchase of right of way property for the Reinhardt Road bridge reconstruction. The DOT will have funding for the project in late summer of 2007. The Martin Road bridge is scheduled for immediate reconstruction. No meetings are scheduled for the Board of Appeals. The Planning Committee will review the final plans for Alexander Bishop Retail business and the Fondy Sports Complex go cart track. No annexations. So far there has not been much snow to plow. There is a large hole on Brown Road near Esterbrook Road. The County is doing the ditch elevations along Townline Road. No Certified Survey Maps or licenses. Sanitary District #3 will hold a meeting on January 22, 2007 at about 6:00 pm. The televising of the sewer lines has shown some problems. The Clerk noted that she needs a new fax machine. She noted that the Action Advertiser will be doing a special section on local businesses and townships. It was recommended that the Town submit an article on the park and the fire department. The Town website needs to be updated.
