January 11, 2010 Monthly Meeting
TOWN OF FOND DU LAC FOND DU LAC COUNTY MONTHLY MEETING JANUARY 11, 2010 7:00 PM The January Monthly Meeting was called to order by Chairman Harold Manske. Present were Chairman Manske, Supervisors Phyllis Giese and LeRoy Schmitz, Clerk Patti Supple, Treasurer Jody Roffers, Attorney Matt Parmentier and various Town residents. Confirmation was made of open meeting notice. Minutes from the previous meeting were approved as presented. Jerry Keenan asked why his tax bill did not show fair market value. The fair market value is not computed on land that is assessed as farm land. On the same note, Chairman Manske reported that the State is considering going to state wide assessing, which would mean that each Township, City and Village would not do an individual assessment. At the present time, there are many questions about the viability of this option. Chairman Manske was contacted by the City of Fond du Lac requesting that the Town post a speed limit of 25 mph between the bypass and the Martin Road Bridge on Martin Road. Traffic coming off the bypass has a tendency to speed along this area. Therefore, motion was made and seconded to approve a resolution posting the speed limit on Martin Road north of the bypass to the City limits at 25 mph. Motion carried. Fire Chief Sanborn reported that the Fire Department Equipment Truck was purchased. The delivery date is around September of 2010. Total cost with the Pierce discount is $294,108.00. The Clerk presented information on fees for apartment plan reviews and occupancy permits. It was noted that in addition to these fees, impact, stormwater and water fees would need to be determined. A development agreement would also be needed for apartment complexes. Plans will soon be submitted by Ann Cook of MSA Engineering, and the proper procedures for review are unclear. After review, it was determined the Board would need to review the procedures and fees at a workshop meeting. The Workshop will be held on January 25 at 6:00 pm. The topic for Stormwater Education for January is carpet cleaning and proper water disposal. Supervisor Schmitz attended the Airport meeting where the topics included the new snowplow used on the runways, and the retirement of Lee Perrizzo. Clerk Supple reported that a copy of a letter sent to Harry Schmitz, Jr. by the County was received. This letter states that Mr. Schmitz has 30 days to remove abandoned vehicles and junk from the property. Thirty days is up on February 4, 2010. A copy of the letter will be forwarded to Attorney St. Peter. On January 19, 2010 a joint Stormwater Meeting will be held, and on January 20, 2010 the Ambulance Committee will be meeting at the Town Hall. No Board of Appeals meetings are scheduled. On the agenda for Planning is review of the burning ordinance, firearms in subdivisions, outdoor burning furnaces and the Boysa Apartment plans. No annexations. Road projects continue to be snowplowing. The State has closed the bridge by Schmitty’s on Winnebago Drive for upgrade and repair. No CSM’s. Motion was made and seconded to approve the operator’s licenses for Amanda Gindt, Louise Zenner, Sean Kok and Tracie Reinke. Motion carried. Sanitary District #6 and #3 meetings are scheduled for January 19, 2010. Town of Fond du Lac polls for the upcoming February election for Oakfield School Board will not be open. Oakfield voters in the Town will have the option to vote by absentee ballot or vote in the Town of Byron. The April election will be held as usual with Town polls opening at 7:00 am. Supervisor Schmitz reported ongoing work on the water tower. Chairman Manske noted that there is a new government program “cash for appliances”. Information on the subject will be in the permit office. FINANCIAL REPORT: December 2009 General Account received: $164,442.13 Orders: 449,077.64 Balance: 21,584.71 CD: $330,000.00 Road, Bridge Culvert & Eq.: $393,181.27 Park: $6494.18 CD: $15,058.42 Recycling: $1.00 Motion was made and seconded to approve the Financial Report. Motion carried. PAYMENT OF BILLS: Bills: $210,336.04 Wages: $13,936.02 Motion was made and seconded to approve the Payment of Bills. Motion carried. Chairman Manske stated that even though Mr. Mathweg had not attended the meeting, the matter of plowing snow in Esterbrook Estates Addition 1 would be reviewed. He reported that the Town has no obligation to plow the snow since there are no houses constructed in the development. He added that there is concern over the manholes in the subdivision being above grade, and that since it is a gravel road, there would be displacement of the stone. Attorney Parmentier noted that the Town could be held liable for manhole damage and water infiltration if they choose to plow the road. While the matter was being discussed, Mr. Mathweg arrived. Mr. Mathweg stated that he had requested the Town plow the roads within one week of a snowfall. He stated that he had received no formal answer other than an e-mail denying the request. Mr. Mathweg asked for reasons for the denial. Chairman Manske stated that the Town was concerned over being held responsible for damage to manholes, water infiltration, curb damage, and gravel displacement. Mr. Mathweg stated he would be happy to have the road plowed with one pass through. He added he would agree to hold harmless the Town for gravel displacement, curb damage, manhole damage and water infiltration. He added he wants to market the land, but the real estate agents are unable to get onto the property. Attorney Parmentier noted the Town would need a formal contract stating the terms for plowing. The recommendation was made to review the contract yearly. Mr. Mathweg objected. After discussion, motion was made and seconded to plow the roads within the subdivision contingent on a signed agreement holding the Town harmless for gravel displacement, curb damage, manhole damage, and water infiltration. In addition, a time frame for plowing would be set and it would be stated the Town would not be setting a precedent for plowing other unfinished subdivisions. The contract would be reviewed yearly.
