January 20, 2009 Joint SD#3 and Town Board

JOINT TOWN BOARD AND SANITARY DISTRICT #3 MEETING
JANUARY 20, 2009 
4:15 PM

The Joint Meeting was called to order by Chairman Harold Manske. 
Present were Chairman Manske, Supervisors Phyllis Giese and LeRoy
Schmitz, Clerk Patti Supple, Treasurer Jody Roffers, Attorney John St.
Peter, Tim Mathweg and his Attorney Sam Kaufman.  Confirmation was
made of open meeting notice.

Attorney St. Peter noted this meeting was being held to solve some of
the issues with Esterbrook Estates Addition 1.  These matters were
raised at the last Monthly Meeting, but Mr. Mathweg requested that his
Attorney be present when some of the matters were discussed.  It was
determined that the contingencies for adoption of the roads in
Esterbrook Estates have been resolved: ie, the stock piles of dirt
have been leveled, the road work has been completed and accepted by
the Town, and the ditching issue has been resolved.  

The sanitary sewer lines issue has still not been resolved.  Phase 1
of the sewer lines have been installed, and Eric Otte has signed off
on the lines.  (In other words, he has approved the installation.) SD
#3 has not accepted ownership of the lines.  At issue is the payment
by Mr. Mathweg of the difference in cost of the installation, and the
cost SD #3 paid for installation plus interest.  Attorney Kaufman
stated that once a lot is sold, payment is made.  This is due to the
fact there is a special assessment on title for each lot.  Mr. Mathweg
would like the money to pay down his loan in a timely manner.  He
wants to hold the extra monies until all three phases of the project
are completed.  SD #3 Commissioners were opposed to this payment
schedule.  They would like payment either as each lot is sold, or
payment in full before phases two and three are started.  It was noted
that Mr. Mathweg has established an escrow account to hold the money. 
Mr. Mathweg also stated that since the sewer lines are installed, the
interest charges from SD#3 have stopped.  However, if the interest
rates stop at the end of phase 1, then payment for phase 1 underages
should also be due.  

Also discussed was the option of SD #3 installing phases 2 and 3 and
charging the cost back to Mr. Mathweg.  Mr. Mathweg requested SD #3
take over the loan for phase 1 or allow him to pay off his loan, then
pay back SD #3.  

There being no consensus on the matter, the meeting was adjourned at
5:25 for both sides to review the options.  Motion was made and
seconded to adjourn.  Motion carried.
