February 11, 2008 Monthly Meeting

PUBLIC HEARING
FEBRUARY 11, 2008
7:00 PM

The Public Hearing concerning the rezoning of the former Timler
property on Forest Avenue Road from Residential and Commercial to
Industrial was called to order by Chairman Harold Manske.  

Sam Tobias from Fond du Lac County Planning gave an overview of the
proposed use of the property.  He noted that plans for the area are
airport related businesses as well as airport hangars.  Brenda Hicks
Sorenson from FDL County Economic Development added that one business
is interested in some of the property.  The total acres involved are
71.  Jerry Keenan questioned where the money was coming from to
purchase the land.  Allen Buechel stated that a bond will be taken to
purchase the property with pay back done with the sale of the
industrial lots as well as FAA funding.  Dean Birschbach was concerned
about traffic on Forest Avenue Road, but Chairman Manske noted that
the road should be able to handle the traffic.  The need for sewer and
water to this area was also addressed.

There being no more discussion, motion was made and seconded to
adjourn to the Monthly Meeting.

MONTHLY MEETING

The Monthly Meeting was called to order by Chairman Harold Manske. 
Present were Chairman Manske, Supervisors Phyllis Giese and LeRoy
Schmitz, Clerk Patti Supple, Treasurer Mel Buechel, Assistant
Treasurer Jody Roffers, Attorney John St. Peter, County Executive
Allen Buechel, County Planner Sam Tobias, County Economic Development
Director Brenda Hicks-Sorenson and various Town residents. 
Confirmation was made of open meeting notice.  Minutes from the
previous meeting were approved as presented.

Tony Koenigs noted that there is heavy equipment running on Fox
Drive.  Chairman Manske stated that he will talk to Tim Mengert about
the problem.  Mr. Koenigs also noted that Ben’s Budget Cab Service is
once again in violation by storing its vehicles on the Esterbrook Road
property and allowing the drivers to park on the property during the
day.  The recommendation was made to observe the business for a week
and note the amount of traffic from the home.  Attorney St. Peter was
directed to notify the owners of the violation.

The rezoning of property on Forest Avenue Road was discussed.  Clerk
Supple reported on the February 6, 2008 Planning Commission
recommendations.  She noted that the Planning Committee recommended
rezoning the property with the following recommendations; a
development agreement to address concerns over sewer and water
construction, utilities and Forest Avenue Road, and that the McDonald
and Giese properties be used to create a buffer for the Industrial
Park.   Attorney St. Peter noted that the development agreement should
be tied in with the plat, not the rezoning.  Supervisor Giese noted
that she is glad that the property would be returned to the Town as
part of the tax base.  Chairman Manske agreed, and noted that this
would be good use of property that up to this time was going to be
hard to develop.  Supervisor Schmitz agreed that it would aid the Town
tax base.  Motion was made and seconded to approve the rezoning of the
Timler property on Forest Avenue Road from Residential/Commercial to
Industrial. Motion carried.  

A meeting is scheduled for February 28, 2008 at 7:00 pm to review the
proposed water district area and cost of the project. 

The development agreement with Fondy Sports Complex was reviewed by
Chairman Manske and representatives from Fondy Sports at a meeting
held at Attorney St. Peter’s office.  Another meeting will be held to
review recommendations on March 11, 2008 at 2:00 pm.

The former Sabel’s Trailer Court now known as Woodland Park is having
water service problems.  In an agreement with the Village, the sewer
issue is addressed, but any water issues will probably require
annexation of the Trailer Park to the Village.

On February 26, 2008 Attorney St. Peter and Chairman Manske will be
meeting with representatives from the Town of Byron and the City of
Fond du Lac to revise the well agreement.

On February 13, 2008 Strand & Associates and the Green Bay DOT will
meet with the Town Board to present different recommendations for the
151 Bypass.

Attorney St. Peter reported that Harry Schmitz has appealed the local
judges ruling, and his case will be sent to the Court of Appeals. 
Attorney St. Peter and the Town’s Insurance Company will have to
present answers to the appeal.

No meetings are planned for the Planning Commission or Board of
Appeals.

No annexations.  

Snow and more snow is the report for road projects!  The transmission
on the small pickup truck is being rebuilt.  The alternator is out on
the Oshkosh truck.   If we get much more snow, the County may need to
haul away snow in some of the smaller cul-de-sacs.  The roads are
cracking badly.

No CSM’s.

Motion was made and seconded to approve the Schmitty’s Bar operator’s
licenses for Bryan LeGault and Michelle Gust contingent on fees being
paid.  Motion carried.
Sanitary District #3 will meet on February 19 at 4:30 pm.

Clerk Supple noted that voting will take place on February 19, 2008
for a Presidential Preference.

Motion was made and seconded to approve the Financial Report.  Motion
carried.

Motion was made and seconded to approve the Payment of Bills with two
corrections noted.  Motion carried.

Motion was made and seconded to adjourn.  Motion carried.
