MONTHLY MEETING
AUGUST 14, 2017
7:00 PM
The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisor LeRoy Schmitz, Clerk Patti
Supple, Treasurer Brenda Post, Attorney John St. Peter and various
Town residents.  Confirmation was made of open meeting notice.
The Pledge of Allegiance was said.
Minutes from the previous meeting were approved as presented.
#4.  Ryan Guckenberger from the Hietpas Group presented the 2016 Audit
Report.  It stated it was a clean or unqualified audit.  Some
highlights from the report are:  cash was down $100,000.00 due to the
payment on the new building, a double payment showing for the turbines
to the City, Sanitary District #3 paid off their loan, a large savings
of over $300,000.00 for refinancing the water tower, and money taken
out of the Road, Bridge and Culvert account for repairs.  Motion was
made and seconded to accept the Audit Report.  Motion carried.
#5 Permit Office Report
1)	On July 11 letters were sent to Daryl Conger and Jim Roberts jr.
about grass & weeds growing on their lots along Rogersville Road. They
complied and cut the weeds
2)	On July 19th a phone call was made to Michael`s real Estate to take
care of weeds growing in an Agricultural zoned parcel along Willow
Lawn & Hickory Road. The Renter has since worked the field up.
3)	On July 25th a letter was sent to the property owner about grass &
weeds growing on bare lots on Osage & South Porte Blvd. A follow up
inspection was made 8/14/17 made grass & weeds were cut.

#6.  Public Works
a.	 A letter of credit is being held on the Streblow Lane project.
b.	Van Horn submitted a signed estimate for the road project.  The
County is working on project costs.  It was recommended to keep
pushing for more updates and a better time line for the project.
c.	Motion was made and seconded to approve the Fond du Lac County
Application/Permit to Construct, Operate and Maintain Utilities Within
Highway Right-of-Way for the Town of Fond du Lac.  Motion carried.
d.	The signed contract concerning the access to the chlorination
building will need to be reviewed since someone has requested to use
the access.  A special meter is needed to calculate water usage for
outdoor water use.  (such as watering lawns or gardens)  Those homes
or businesses on public water need to have water use metered.
e.	The topic for Stormwater is “Ditches”.
Chairman Giese noted that Martin Road will have culvert repair work
done and Brown Road work is scheduled.  The other road work if time
and money permits are, in order of importance, Miranda Way, Valley
Court, and Burch Court.
#7 Quality Truck Berm
Attorney St. Peter reported that due to questions on the Quality Truck
Berm and the upkeep and maintenance of the same, some research was
done.  The berm appears to have been constructed on the adjacent
property now owned by Joel Streblow.  In September of 1986 the berm
was discussed at  a Planning Committee meeting.  The Covenants for the
Commerce Court Plat in 1986 mention a control committee to oversee the
project.  The draft of an agreement from 2000 shows a berm on the
Quality Truck property.  This is the extent of the paperwork the Town
has in its possession. One thing is clear, the Town is not the control
committee for the project.  The Town does not need to  pursue any
action on Quality Truck since there is no paperwork giving the Town
jurisdiction to do so.  There might be a legal issue for a nuisance
claim.  However, there is no documentation to enforce the construction
of a berm.  This is why the Dufrane recorded document is so important.
 It allows the Town to enforce the upkeep and maintenance of the
berms.  As to the Covenants for the Commerce Court Plat, it appears
the control committee started as Averbeck and Patin, and once the
residential lots were sold it became Joel Streblow and the owner of
the one residential house.  At the request of the neighboring property
owners, the Board agreed to have St. Peter Law Office send a  letter
to the above mentioned property owners asking for help with the berm
upkeep.  
#8  Herr Baker Field and the Dock Spiders
The baseball season is coming to an end, and no complaints were
received from neighboring property owners concerning noise or parking.
 On September 13 a meeting will be held to review the season.
#9  Auxiliary Power for the Water system
A generator is needed to provide water to residents in case of a power
failure.  Eric Otte is checking into options.
#10  Operator’s Licenses
Motion was made and seconded to approver Provisional Operator’s
Licenses to Hailey Rushing and Jeremy Zupke at the Nut House until
proof of class and fee is paid.  Motion carried.
#11  Chairman’s Report:
 I would like to clear up some misconceptions.  George St. Peter was
one of the Town’s first attorneys.  He kindly came to the Monthly
Meetings as a courtesy to the Town of Fond du Lac and did not charge
for this service.  John St. Peter has continued this courtesy.  The
Monthly Meetings that he and Matt Parmentier attend have no cost to
the Town.  In addition, Mary Jo Kraus of St. Peter Law Office types up
the agenda for the Monthly Meetings.  She sends notice to the Reporter
and distributes the agenda to the Board.  This routine was established
long before any member of this Board was elected.  While Mary Jo types
the agenda, it is the Town Board that determines what goes on the
agenda.  
Usually around August or September, the Town Board calls a workshop
meeting to evaluate employee job performance and pay increases.  The
pay is approved at either a September or October meeting.  Due to
increased rules on discussing these matters during open meetings, in
the future evaluations will be done in closed sessions.
In addition, it is impossible for the Town Board to enforce covenants
unless the Town is listed as part of the enforcement.  Committees
directed by the Covenants are responsible for enforcement.
#12 Upcoming Meetings.
The County Highway will be holding a meeting and the OSG also will be
meeting.  
#13  There are no Planning or Board of Appeals meetings scheduled.
#14.  Clerk Supple noted the Town’s census shows a population of 3766.
 The annexation of property on Hickory Road for the County Garage was
received.
#15 Public Comments.  
Public comments were made by Tim Murphy, Mary Leasa, Stephen Yanke,
John Zeleske and Mary Gorske.  
Robert Moodie asked for copies of the records on the Van Horn road.
Tim Murphy noted the dead end sign on River Road needs to be
straightened.

Motion was made and seconded to approve the Financial Report.  Motion
carried.
PAYMENT OF BILLS:
Bills:  $55,015.73   Wages:  $14,291.48
Motion was made and seconded to approve the Payment of Bills. Motion
carried.
	The Town Board intends to convene into closed session pursuant to
Wis. Stat. § 19.85(1)(e) for the purpose of deliberating or
negotiating the purchasing of public properties, the investing of
public funds, or conducting other specified public business, because
bargaining reasons require a closed session.
After the Closed Session, motion was made and seconded to adjourn.  
Motion carried.
