March 13, 2017 Monthly Meeting

PUBLIC HEARING
MARCH 13, 2017
7:00 PM
The Public Hearing was called to order by Chairman Robert Giese.  
The first Public Hearing was on the rezoning of the Dennis and Sheila
Seefeld property at N5689 Seefeld Road  from Commercial to Residential
Medium Density zoning.  There were no comments.
The second Public Hearing was on the rezoning of the Van Horn property
at N6652 Esterbrook Road from Residential to Commercial.  There were
no comments.
The third Public Hearing was on the rezoning of the John Zeleske
property at W6262 Willow Lawn Road from Residential to Agricultural. 
Mary Gorske stated she would like the property to be zoned
agricultural since that was what the property was zoned when she moved
to the area.  
There being no more public comments, motion was made and seconded to
adjourn to the Monthly Meeting.  Motion carried.
MONTHLY MEETING
The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisors LeRoy Schmitz and Dave
Schmitz, Clerk Patti Supple, Treasurer Brenda Post, Attorney John St.
Peter and various Town residents and guests.  Confirmation was made of
open meeting notice.  Minutes from the previous meeting were approved
as presented.
PUBLIC COMMENTS:
Aaron Sadoff from the Village of North Fond du Lac School District was
present to explain to the North Fond du Lac School District residents
the two referendums on the upcoming ballot.  He explained the need the
District has for updating and remodeling several school buildings to
better accommodate the students and staff.  He thanked the residents
for their support.
Charlie Martin expressed concern over the vision triangle on Fox Drive
and Fox Court. 
Mary Leasa, Tim Murphy and Stephen Yanke expressed their concerns
about the Dufrane property
#4.  Girl Scout Troop 8530 presented information on the Free Public
Library they would like to set up at Simon Park.  It would be
maintained by their troop and provide books for adults, teens and
children.  This is part of a larger free service provided throughout
the country.  Motion was made and seconded to approve the installation
of the Free Public Library at Simon Park with the Girl Scout Troop to
maintain.  Motion carried.  The Board thanked the girls for their fine
presentation.
#5.  The Pizza Hut liquor license and operator’s license applications
are on hold for now.  
#6.  Motion was made and seconded to adopt by resolution the
Comprehensive Plan with changes discussed at the workshop meeting. 
Motion carried.
#7  Tom Janke was present to open bids for asphalt on the Brown Road
project.  One bid was received from Northeast Asphalt.  After
discussion, motion was made and seconded to accept the bid from
Northeast Asphalt.  Motion carried.  The Town has also received a
grant from LRIP to help defray costs.  The quote from the County
includes the overlay on the road at the same width with tree removal
and ditching.
#8 Clerk Supple reported after review, the Planning Commission
recommended to the Town Board  the approval of the Seefeld rezoning
from Commercial to Residential Medium Density.  The City of Fond du
Lac also approved the rezoning as it is in the City Growth area. 
Motion was made and seconded to approve the rezoning of N5689 Seefeld
Road from Commercial to Residential Medium Density.  Motion carried.
#9  Clerk Supple reported after review, the Planning Commission
recommended to the Town Board the approval of the Van Horn rezoning
from Residential to Commercial.  The land is an approximately 400 foot
strip south of the present Commercially zoned property owned by Van
Horn at N6656 Esterbrook Road.  Motion was made and seconded to
approve the rezoning from Residential to Commercial the following
described property:  part of the NE ¼ of the SE ¼ of Section
7, Township 15 North, Range 17 East, Town of Fond du Lac, Fond du Lac
County, Wisconsin, which is bounded and described as follows:
Commencing at the east quarter corner of said Section 7; thence S
01º02’30” E, along the east line of said SE ¼, 1032.67 feet
to the point of beginning of lands herein described; thence continuing
S 01°02’30” E., along said east line of the SE ¼, 300.00 feet to
the southeast corner of said NE ¼ of the SE ¼; thence S
89º03’12” W, along the south line of said NE ¼ of the SE
¼, 669.93 feet to the southwest corner of the E ½ of said NE
¼ of the SE ¼; thence N 00°57’20” W, along the west line of
said E ½ of the NE ¼ of the SE ¼, 300.00 feet; thence N
89º03’12” E, parallel with said south line of the NE ¼ of
the SE ¼, 669.48 feet to the point of beginning.
Motion carried.
#10.  Clerk Supple reported that the Planning Commission reviewed the
application of John Zeleske for the rezoning of W6262 Willow Lawn Rd
from Residential to General Ag.  The Planning Commission reviewed the
application and recommended that the application be denied because the
parcel does not meet the standards of the General Ag District.  In
addition, because the parcel is located within the City Growth Area as
defined in the Town-City intergovernmental agreement, the City’s
approval to rezone is required.  In a letter dated February 27, 2017
the City objected to the proposed rezoning because (a) it conflicts
with adjoining land uses, (b) the parcel is too small for agricultural
uses, (c) the City’s Comprehensive Plan calls for industrial use in
the area, and (d) rezoning would constitute spot zoning.  Motion was
made and seconded to deny the rezoning of W6262 Willow Lawn Rd from
Residential to General Ag for the reasons cited by both the Planning
Commission and the City.  Motion carried.  
#11.  There is no update on the ad hoc committee to reopen Rogersville
Road.
#12.  There is no update on the activity report from the Permit/Code
Enforcement Office.
#13.  a.  The Streblow Lane letter of credit reduction is on hold for
comments from Gremmer & Associates on how much is needed yet for the
road repairs.
b.  The Van Horn property was rezoned.
c.  No update on the water system.
d.  Motion was made and seconded to approve the yearly MS-4 Annual
Renewal and submit the report to the state.  Motion carried.
#14.  Motion was made and seconded to approve the operator’s license
for Tansy Froemming, The Nut House contingent on payment of the $15.00
license fee.  Motion carried.
Motion was made and seconded to approve operator’s licenses for
Christine Kimpel, The Nut House and Jeffrey Zschetzsche, The Nut
House.  Motion carried.
#15.  Supervisor L. Schmitz reported at the Highway Committee meeting
the subject of Highway 23 being a project 2o years in the future.  He
also discussed the option to borrow money from the at a 5 to 6 percent
rate.
#16.  The Planning Committee has no meetings planned.  The Board of
Review will meet to review plans for a storage building on Winnebago
drive.
#17.  Clerk Supple reported April 4, 2017 is election day.
