October 10, 2016 Monthly Meeting

FOND DU LAC COUNTY 
PUBLIC HEARING
OCTOBER 10, 2016
7:00 PM
The Public Hearing on the Dufrane Rezone was called to order by
Chairman Robert Giese.  Clerk Patti Supple read the recommendation of
the Planning Committee.  The Planning Committee recommends the Town
Board rezone the Dufrane property to Commercial except for a
delineated location which includes the present berm.  
Mr. Jim Dreifuerst, owner of the property would like the entire lot
rezoned to commercial. He appreciates the time and effort the Town
Board and Jim Supple have taken on this matter.  He attests:
1.	 The property has been used as commercial since 1984 and taxes have
been paid on commercial zoning.  Commercial zoning is needed to
successfully run a business.
2.	The present berm is sufficient screening.
3.	Split zoning only adds to confusion and dissension. 
4.	Willing to plant more trees for additional screening.
5.	Property values have not been affected in the last 32 years.
Those neighbors opposed to the rezone put forth the following:
1.	 Who asked for the rezone?  The present zoning should be upheld
since it was zoned for the protection of neighboring property owners.
2.	Who is looking out for the interests of the Town residents?
3.	State statutes indicate a description of the property must be
presented at the time of the rezone.  Per Attorney John St. Peter, the
rezone can be delayed until the description is provided.
4.	The Town Board is not upholding the ordinances and is trying to
make what is illegal legal.
5.	Deterioration of property values.
6.	Encroachment on neighbor’s property that has not been addressed.
7.	Restoration of the berm.
8.	Use arbitration  to address issues.
9.	Lack of proper documentation to support zoning.
10.	Noise issues not addressed.
There being no more new issues, motion was made and seconded to
adjourn the Public Hearing.  Motion carried.
MONTHLY MEETING
The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisors LeRoy Schmitz and Dave
Schmitz, Clerk Patti Supple, Treasurer Brenda Post, Attorney John St.
Peter, and various Town residents.  Confirmation was made of open
meeting notice.  Minutes from the previous meeting were approved as
presented.
Chairman Giese presented the Rick Martin Driveway Apron Agreement to
John Zeleske for review.
PUBLIC COMMENTS:
Mary Gorske thanked the roadmen for cutting the ditches so well.
Judy Freismuth and James Skrenes asked about a kennel license for
their property on Leonard Drive.  They would like to take in rescue
dogs through Sandy Paws rescue operation.  They would foster for two
weeks to a month before the pets are adopted.  It was recommended they
go to the permit office for the paperwork for the appeal process. 
They would also like to take down the trees alongside their driveway
approach since the roots from the trees are damaging the driveway
pavement.  They can take down the trees.
4.  Action on the rezoning of the Dufrane Property.  Supervisor L.
Schmitz stated the property should be zoned commercial with a berm
maintenance agreement added as part of the rezone.  He also feels the
berm or a fence should be extended to cover the Dufrane portion of the
driveway area.  Chairman Giese noted a lot of research went into
researching the history of the property and the mapping.  Of concern
is about ½ of the Dufrane building is in residential zoning.  The
residential lots owned by Streblow are delineated as residential use,
yet on the Dufrane property, commercial business was allowed and
buildings were constructed. Supervisor D. Schmitz asked if a variance
would be allowed.  Attorney St. Peter strongly believes there would be
a battle over the variance.  Use would remain a problem.  Supervisor
D. Schmitz asked Mr. Dreifuerst why he asked for the entire property
to be rezoned since the berm area must remain unused.  Mr. Dreifuerst
said he feels the buffer area remaining residential would always be a
source of problems.  Attorney St. Peter noted the deed restriction
would be recorded and the upkeep of the berm would be enforceable per
the document.  The Town Board would create the document.  Supervisor
L. Schmitz made a motion to rezone the Dufrane property to Commercial
with a recorded deed restriction written by the Attorney under the
direction of the Town Board and a control committee appointed.  The
motion died for lack of second.  After discussion of an engineered
legal description  and the property owners approval being needed and
the enhancement of the berm, Supervisor L. Schmitz made a second
motion.  Motion by L. Schmitz: rezone the Dufrane property to
commercial, with an adequate buffer being described, a recordable deed
restriction for the maintenance of the berm, and the rezoned to take
place once the deed is recorded.  Motion was  seconded by D. Schmitz. 
Motion carried, 3 aye.
5. The Certified Survey Map for Nic and Joyce Backhaus was presented. 
The property will be split into 2 lots due to the Wild Goose Trail
splitting the property.  This is being done for estate planning. 
Motion was made and seconded to approve the CSM.  Motion carried.
6  a.  The outside cleanup of the property at W5194 Bechaud Beach
Drive has been completed.
b.  Kip Jones of W5047 Mariearl Lane wanted more direction on the
carport/garage permitting needed.  Since Mr. Jones had constructed the
carport enclosure without proper permits or building plans, the
addition must be returned to its original condition.  Any fencing must
be approved by the Building Inspector.  If he wants to enclose the
area, permits will be needed for any work, including fencing.   He
must resubmit his plans to the Board of Appeals if he wants to enclose
the carport.  Motion was made and seconded to give Mr. Jones 30 days
to restore the structure to its original condition.  Motion carried.
7.  a.  the County is satisfied with the Van Horn plans.  Mr. Moodie,
the adjacent property owner asked for an update on the plans. 
Basically, the original location of the road was approved by the
County and will be at the Commercial width.
b.  The water system study is still under review.  The refunding of
the water utility bond will be done at the budget hearing in November.
  The water study should be forwarded to ECRP for review.
c.  The topic for Stormwater is “Leaves on the Land”.
8.  This matter was discussed in #7 (b).
9.  Harry Lange was asked for the progress in reopening Rogersville
Road.  It was recommended he contact John Wehner of the County Airport
for direction.
10.  The following Poll Workers were appointed for the November
election:  Diane Beck, Phyllis Giese, Ginny Knecht, Loretta Koenigs,
Kevin Moore, Kelly Mueller, Mary Neuman, Deb Parduhn, Lori Ransom,
Betty Ryan, Ann Schob, Cathie Seffern, Sheila Seefeldt, Charlene
Schlepter, Sally St. Peter, Judean Wise, Barb Woehlke, Mary Leasa,
Mary Karrmann,  Jim Supple and Bob Giese.  Motion carried.
11.  Motion was made and seconded to approve the following pay
increases:
Brian Balson, Tony Esposito, Tim Schrage, Mike Supple to $14.50 per
hour for summer work and $16.00 per hour for plowing,
Rod Baumann, $15.00 for summer and $16.50 for plowing
Ron Schmidt $19.00 per hour, $1000.00 for retirement and Thanksgiving
and Xmas gifts of $50.00 each.
Craig Sanborn to $8740.00 per year and Jim Supple reimbursement to
increase by $50.00 per month.
Motion carried.
12.  Motion was made and seconded to approve operator’s licenses for
Brian Ruch of Engie’s and Katie Wiese of Aldi’s.  Motion carried.
13.  Chairman Giese reported that there is not enough State money to
start the Hwy 23 east project.  There will be turn lanes installed by
the old Betz Interiiors building and by Esterbrook Road.  The City of
Fond du Lac will be taking over jurisdiction from just south of
Takodah Drive on Highway 45.  It will become an extension of Fond du
Lac Avenue.
14.  The Board of Appeals will meet on Oct. 26 for the Kay Jewelers
Sign by the Bayfield Mall property.  There is nothing scheduled for
Planning.
15.  The Bowmar Contract will need to be approved in November.  Ron
Schmidt will be back to work on Thursday on a limited basis.
