PUBLIC HEARING
MARCH 14, 2016
7:00 PM
The Public Hearing concerning the request from Robert Merrill to
rezone his property north of the railroad tracks on CTH K from General
Agriculture to Farmland Preservation was opened by Chairman Robert
Giese.  Clerk Patti Supple reported that Mr. Merrill was requesting
the rezoned in order to collect the Farmland Preservation fees on his
taxes.  The original rezone to GA was approved by the County and the
State of Wisconsin.  However, the property is one parcel connected to
a FP zoning which is not permitted per the State of Wisconsin. 
Therefore, the County had no problem with the Town rezoning the
property to FP.  There being no discussion, motion was made to close
the Public Hearing and adjourn to the Monthly Meeting.  Motion
carried.

MONTHLY MEETING
The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisors LeRoy Schmitz and Dave
Schmitz, Clerk Patti Supple, Treasurer Brenda Post, Attorney John St.
Peter and various Town residents.  Confirmation was made of open
meeting notice.  Motion was made to approve the minutes from the
previous meeting with one correction.  It is Mr. Halfman not Hoffman
under code enforcement.  Motion carried.
PUBLIC COMMENTS:
John Zeleske asked who gave the Assessor the authority to go on his
property March 4 to assess his buildings.  Attorney St. Peter reported
that the Assessor has the authority to go on any property to update
records and assess property.  No one authorizes the Assessor to go
onto property.
Tony Koenigs noted the new training classes are starting for the Fire
Department.
Steve Yanke asked if a no littering sign could be installed on
Willowlawn Road.  Attorney St. Peter stated the Town does have a no
littering law, but before any action can be taken, the person must be
caught.  It is difficult to determine who has littered unless they are
caught in the act.  Chairman Giese reported that a sign usually makes
no difference to those doing the littering and the ongoing costs can
be expensive with sign maintenance.  Mary Leasa noted the recycling
truck does a lot of littering as they drive along.  Supervisor D.
Schmitz recommended putting the recycling in bags inside the bins to
help alleviate the problem.  
The Robert Merrill rezoning was taken under consideration.  Motion was
made and seconded to rezone the property north of the railroad tracks
to FP per Mr. Merrill’s request.  Motion carried.
The Final Plat, Development Agreement, and Tax Agreement were
presented to the Town Board for approval.  Clerk Supple reported the
Planning Commission recommended approval of the Final Plat along with
the storage buildings conditional on 6 trees or evergreen trees or
bushes 2” or over in circumference being planted on the Streblow Drive
entrance to the storage units and the Gremmer recommendations being
followed, the recommendations of Sam Tobias and the final development
agreement and tax agreement being signed.  After discussion, motion
was made and seconded to approve Final Plat, Development Agreement,
Tax Agreement and storage units conditional on all Planning
Commission, Gremmer and Sam Tobias recommendations being followed. 
Motion carried.
CODE ENFORCEMENT:
The Dufrane issue was tabled by the Planning Commission for more input
from Gremmer and Associates on other ways to access the property and a
reimbursement agreement being signed by Mr. Dreifurst.  It was noted
that no rezoning has been requested.  Attorney St. Peter noted the
matter had been turned over to the Planning Commission so more facts
can be ascertained concerning the driveway.  Mary Leasa reported that
neighbors have other concerns such as encroachment on private
property.  This matter is an issue between neighbors.  Attorney St.
Peter recommended communicating their concerns with Mr. Dreifurst.
At issue as yet are the unattached flares on the Schaetzel culvert. 
The matter will be reviewed in April when hopefully the ground is
drier.
A letter was sent today to Dan Halfman at N7043 Winnebago Drive with a
deadline of 30 days to remove excess debris and unlicensed vehicles
from his property.
Mark Piwoni of N7132 Leonard Drive was notified to keep his dog under
control.
PUBLIC WORKS:
The status of the Van Horn project will be checked.
Ryan Sommers of Westfield Hideaway stated he had done some research on
the 2005 Development Agreement and the 2007 splitting of the lots
among the original developers.  He noted in 2008 the LLC was dissolved
and property allocated to the 3 owners.  Of concern is the dissolved
LLC appeared to continue as a single entity.  Chairman Giese added
that Eric Otte has some more information on the project, and Attorney
St. Peter noted the group continuing to act as a corporation may be
significant.  It is hoped more information will be available at the
April meeting.
The Village of North Fond du Lac had more questions on the water study
but Nick Leonard is working to get the project completed.
Other Public Works projects include hiring Excel Underground to do
locates for the Water Utility and to hire someone to paint the
hydrants.  It was recommended to move forward with painting the
hydrants.  While Supervisor L. Schmitz recommended using high school
kids for the painting, Supervisor D. Schmitz recommended using the
part-time Town help.
Motion was made and seconded to approve the 2015 Annual Stormwater
Report and submission to the State DNR.  Motion carried.  The
Stormwater topic for this month is “The Perfect Lawn”.
Motion was made and seconded to approve the following as poll workers
for 2016/2017:  Diane Beck, Phyllis Giese, Bob Giese, Shirley Gurath,
Loretta Koenigs, Kevin Moore, Kelly Mueller, Deb Parduhn, Lori Ransom,
Betty Ryan, Cathie Seffern, Sheila Seefeldt, Charlene Schlepper, Sally
St. Peter, Jim Supple, Judean Wise, Barb Woehlke and Chief Inspectors
Mary Karrmann and Ginny Knecht.  Motion carried.
Motion was made and seconded to appoint Tony Koenigs and Tony
Beregszazi  to the Board of Appeals and Scott Roltgen and Ryan
Kamphuis to the  Planning Commission.  Motion carried.
A temporary stop sign was installed on Paradise Lane off Valley Creek
Road.
Discussion at the State level has been on updating the Highway 41 and
Townline corridor as well as work to the Highway 23 and Esterbrook
Road intersection during 2017 and 2019.
The camping issue outside a mobile home park or campground was taken
up by the Planning Commission.  In a 4 t0 1 vote it was recommended to
deny camping outside the mobile home park or campground due to the
difficulty to enforce time limits and locations.  Motion was made by
Supervisor L. Schmitz and seconded by Chairman Giese to deny the
camping zoning change.  Motion carried with Supervisor D. Schmitz
opposed.
Chairman Giese and Supervisor D. Schmitz attended the WI Towns
Association meeting.  Elected officials discussed various topics.  Of
special consideration is the State wanting to take over the Board of
Review and have the County oversee the reviews.  A pilot program of
$56,000.00 would be funded by the State.  After the pilot program,
costs would be assumed by the County.  At the present time there is no
added cost for the Board of Review on the Townships.
Roadman Ronald Schmitz and Chairman Giese attended a blacktopping
seminar.  Supervisor L. Schmitz attended the Highway Department
meeting concerning the Highway 23 and CTH K turnarounds.  The
ambulance meeting scheduled to meet at the Townhall was actually
scheduled for the Village hall.  Ambulance fees were lowered 5% by the
Village, and the old ambulance is up for sale.  The new ambulance is
due in late March or early April.  The Village is still looking for a
director.  The next meeting is scheduled for April 21st at the
Townhall at 6:30 pm.
The Board of Appeals will meet to review the John Vogds shed and the
Planning Committee will meet to review the Pit Stop Portables request
and Dufrane driveway access.
A workshop wlll be held on March 30 at 5:00 pm.  
Clerk Supple reported on foreclosures in the Stillwater Estates, the
Montsma large equipment permit and the April 5, 2016 election. 
Roadman Schmidt will be attending a County Safety meeting.

Motion was made and seconded to approve the Financial Report.  Motion
carried.
PAYMENT OF BILLS:

Motion was made and seconded to approve the Payment of Bills.  Motion
carried.
The Town Board intends to convene into closed session pursuant to Wis.
Stat., § 19.85(1)(g) for the purpose of conferring with legal counsel
for the Town who is rendering oral or written advice concerning
strategy in litigation in which the Town is or is likely to become
involved and pursuant to Wis. Stat., § 19.85(1)(e) for the purpose of
deliberating or negotiating the purchasing of public properties, the
investing of public funds, or conducting other specified public
business, because bargaining reasons require a closed session.  In
closed session, the Board will discuss negotiations with the City of
Fond du Lac regarding the existing Intergovernmental Agreement. (roll
call vote required):

The Board convened into closed session. 
Immediately following the closes session motion was made and seconded
to adjourn.  Motion carried.
