December 14, 2015 Monthly Meeting

PUBLIC HEARING
DECEMBER 14, 2015
7:00 PM
The Public Hearing was called to order.  Under consideration is the
amendment to the Zoning Ordinance and Building Code for the
definitions of buildings and structures.  Attorney John St. Peter
explained that due to some apparent discrepancies in the definitions
of buildings and structures the changes need to be made.  After an
unusual judgment from a recent court case, the changes will hopefully
close the gap.  Dan Gurath asked for more information on what is a
structure.  Under the new definition, a building is a structure.  John
Zeleske noted that his building is on wheels, and he wants to let his
sister use the building on her property.  Under the new definitions,
the building cannot be moved to his sister’s property.  He however,
due to the Judge’s ruling, can continue to use the building.  Any
structure/building set on the ground either on the structure itself,
or on wheels, posts, etc. will need a building permit.  Mr. Zeleske
went on to note he has put up two carports- 20 X 20- which are not
affixed to the ground.  No building permits were issued.  Attorney St.
Peter stated these carports could be an issue.  Mr. Zeleske stated
these carports are totally mobile and are used to keep the moisture
off his wood piles.  Attorney St. Peter stated he is not ready to
render opinion on the carport.  Dan Gurath expressed concern over the
safety of unanchored structures and what kept them in place.  Mr.
Zeleske said the wood piles keep them in place. Tony Koenigs stated he
felt the ordinance changes were good and was glad that mobile homes
were still no allowed.
There being no more discussion the Public Hearing was adjourned.

MONTHLY MEETING
The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisors LeRoy Schmitz and Dave
Schmitz, Clerk Patti Supple, Treasurer Brenda Post, Attorney John St.
Peter and various Town residents.  Confirmation was made of open
meeting notice.  Minutes from the previous meeting were approved as
presented.
Public Comments:
Loretta Koenigs asked for clarification on closed sessions and how
closed session decisions and topics can come up in the minutes if the
subject is not on the agenda.  Attorney St. Peter explained that
closed session topics are determined by State Statutes.  After the
closed session, the meeting is adjourned.  Until the topic under
closed session is finalized, the topic is not discussed during open
session.  It appears that the topic under discussion concerned a court
case that was recently decided through the judicial system.  The final
decision of the judge was not specified as an agenda item.  However, a
question was asked about the status of the court case at a recent
meeting and the question was answered and added to the minutes.  The
Board apologizes for any confusion.  
Under consideration is the amendment to the Zoning Ordinance and
Building Code.  Attorneys St. Peter read the proposed changes.  Motion
was made by Giese and seconded by D. Schmitz to approve the changes to
the definition of a building and structure in the Zoning Ordinance and
Building Code.  Motion carried.  It is hoped the changes clear up the
gray areas since the changes were written with Judge Peter Grimm’s
comments in mind.
After the recent discussion about Christmas bonuses for the part time
help, the question of appreciation for the Fire Department member’s
volunteer work was questioned.  The service of the members of the
Volunteer Fire Department and EMT squad is appreciated and
acknowledged by the Board.  In addition, the Fire Chief receives a
monthly wage, there is a yearly stipend for the Assistant Chiefs and
Captains-which was recently increased, and the Board provides money
for the various appreciation dinners as well as pizza and beverages. 
In addition, a form of retirement insurance has been started for long
term service in the department.  Also a Fireman of the Year award has
been in effect for the last two years.
Permit Issuer and Code Enforcement Officer Jim Supple had nothing to
report.  However, Chairman Giese noted that complaints have increased
over the continued use by Dufrane Moving of the driveway access off
River Road.  This access point was not constructed to handle continued
use, and damage is being done to the entrance.  There is no
documentation on the actual use of this driveway.  However, when CTH D
was reconstructed, acceleration/deceleration lanes were established on
CTH D for the use of Dufrane.  It was recommended this topic be on the
January agenda.
There is no update on Van Horn frontage road progress.
Scott Swick has requested updates on the Westfield Hideaway road
situation.  He is trying to sell lots in the subdivision, and is
concerned over the possibility of the property owners having to pay
for the road upgrades.  This matter will be on the January agenda.
There is no update on the water system study.
The topic for Stormwater management is “Ice and Snow Control”.
The renewal of the Town’s insurance was reviewed.  Attorney St. Peter
had some questions about policy coverage that were forwarded to the
Horton Group for review.  All but one of the questions were answered. 
The issue yet to resolve is the Water Utility District coverage.  A
questionnaire concerning the Water Utility District is being completed
and will be forwarded to the Horton Group.  Motion was made and
seconded to approve the renewal of the Town’s insurance with the
Horton Group.  Motion carried.
Motion was made and seconded to approve the Resolution to borrow
$300,000.00 for the DPW building.  Motion carried.  Attorney St. Peter
noted that page 4 of the resolution notes this is a tax exempt
obligation which affords the Town a lower interest rate.  In addition,
@ $29,261.00 will be borrowed to cover the Emery Lane reconstruction. 
Five residents paid in full and the rest opted for the 10 year plan.
John Zeleske requested to be on the agenda to discuss the rezoning of
his property to general agriculture.  He asked to read his 8 minute
letter without interruption.  Highlights of his presentation included:
 interference with his livelihood, the use of the property for both
animal, vegetable and fruit production, continuing harassment and lack
of proper notification of the rezone to residential use.  Copies of
the letter were provided to Board members and Attorney St. Peter.
Due to recent plans by Milwaukee to send sex offenders to Fond du Lac
County upon release, an ordinance was drafted to limit the placement. 
(Attorney St. Peter noted that a judge in Milwaukee was going to
release a violent sex offender to a home in the Town of Eldorado. 
Residents from the area were opposed to the release of an out of
County offender into their community.)  Several municipalities have
decided to adopt an ordinance limiting the release of offenders to
those with family ties to the community.  Therefore, motion was made
and seconded to approve a Sex Offender Ordinance.  Motion carried.   
The Board commends Attorney Matt Parmentier for notification of the
need to protect the community.
Due to an increase in costs for reviewing and answering assessment
letters, motion was made and seconded to increase the fee from $15.00
to $25.00 per request. Motion carried.
The CSM for the Westwind Strip mall on Rolling Meadows Drive was
presented for review.  Motion was made and seconded to approve the CSM
contingent on a development agreement for the parcel when developed. 
Motion carried.
Eric Freiberg presented the CSM for property at N5401 CTH D.  There
was concern over access to the farmland property that remains.  He
noted there is frontage access off CTH D as well as the present
driveway access point that will continue to be used.  Motion was made
and seconded to approve the CSM.  Motion carried.
Motion was made and seconded to approve operator’s licenses for Amber
Lefeber at East Shore Mini Mart and Jacqueline Declue for Engies. 
Motion carried.
Supervisor L. Schmitz attended the Highway committee meeting and
Chairman Giese attended a government related meeting in Stevens Point.
  
There are no Board of Appeals meetings planned.  The Planning
Committee will meet to review a Preliminary Plat for Manske Industrial
Park on Hwy 23 and the final plat for Sweet Wisdom subdivision.  A
meeting will also be held on January 13 for the Comprehensive Plan.
The Simon Park land rental agreement will be on the January agenda. 
Chief Inspectors and Clerk Supple will be attending classes on the new
voting machine.   Supervisor L. Schmitz commented that the Fire
Department wants the pictures put back on the walls.  Clerk Supple
noted that Brian Balson will be putting up the pictures, but is
updating some.  The maps need to be updated before they are rehung.
