July 13, 2015 Monthly Meeting

PUBLIC HEARING
The Public Hearing concerning the Mobile Tower Siting Ordinance was
called to order.  Since the State has changed the allowable
requirements Town’s can mandate for cellular towers, the Town has to
adopt a new ordinance.  The State ordinance was sent to the Planning
Committee for review.  The only allowable change the Committee made
was to designate to whom in the Town the application must be
submitted.  
Dan Gurath asked what towers this covered.  It is for cellular towers
permanently placed in the Town.  The height limits are mandated by
State Statutes and the airport has the final say on height in this
area.
Sheila Seefeldt noted that the property lines are not respected by the
Tower owners.  Attorney Parmentier stated that the private property
owners who contract with the Tower owners have more say on what is
allowable.  
The mandated minimum set back from private residents is 1.1 times the
height of the tower.  No setbacks can be mandated by the Town.  
There being no more discussion, motion was made and seconded to
adjourn.  Motion carried.

MONTHLY MEETING
JULY 13, 2015
7:00 PM

The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisors LeRoy Schmitz and Dave
Schmitz, Clerk Patti Supple, Treasurer Brenda Post, Assistant
Treasurer Jody Roffers, Attorney Matt Parmentier and various Town
residents.  Confirmation was made of open meeting notice.  Minutes
from the previous meeting were approved as presented.
Chairman Giese noted that there have been several calls concerning
wild animals in residential areas, especially in the Bechaud Beach
area.  He noted that if the animal is on private property the property
owner should be responsible for removal but what happens on Town
property?  Should the Town hire or contract with a company for removal
of these animals?  The subject will be on the August agenda.
There are some work orders needed to add a 15 mile per hour road sign
on Bechaud Beach Road where the sign was removed.  In addition, a No
Thru street sign is needed on Grove Street where it dead ends.  
John Zeleske noted that the Advanced Disposal truck puts both his
garbage and recycling in the same truck.  This matter will be
addressed with Advanced Disposal.  In addition, there are some semi
trucks using Willow Lawn Road for a short cut.  The Sheriff will be 
notified of this matter.
Due to Jody Roffers resignation, a new treasurer is needed.  After
careful consideration, motion was made and seconded to appoint Brenda
Post as the new Town Treasurer.  Motion carried.
Jim Supple, Code Enforcement noted he has sent out letters to Seifert
and Bank of America concerning weeds.  No response from either party
so Touch the Earth was authorized to cut the weeds on both properties
and the cost will be added to their tax bills.  A letter was sent to
Short and Sassy concerning weeds covering the fire number signs. 
There has been no follow up on this as yet.  On July 9th, a letter was
sent to Joel Streblow concerning weeds on his 10 acre parcel on Grove
Street.  No response as yet.  There is a fire number sign by the
hangar on Grove Street that is down, and there are several road signs 
to order.  
Motion was made and seconded to approve the Mobil Tower Siting
Ordinance with the addition of the correct person to submit the
application added.  Motion carried.
Emery Lane has been blacktopped and shouldered.  Once the bill is
submitted, Attorney Parmentier will update the contracts with the
residents concerning the payback amounts.
There is no update on the water system study.
There is no update on Streblow Lane.  Chairman Giese noted he went
through one of the new apartments and was impressed with their
construction.
There was no new topic for Stormwater, so it was recommended to review
pamphlets on the tract rack.
There has been a request to amend the Town Ordinance that does not
allow camping except in a designated campground or trailer park. 
Chairman Giese expressed opposition to amending the ordinance.  He
felt the ordinance was in place due to abuse of the privilege to camp
along Lake Winnebago.  He noted that many years ago residents let
people camp on their lake lots for the summer.  They hooked into the
sewer and were not charged for usage.  The situation got out of hand
and the ordinance was adopted.  Fred Heller, one of the residents
asking for the ordinance to be amended, said the camping could be a
permitted use.  And hookup to sewer could be monitored or the waste
could be stored and taken elsewhere.  Supervisor L. Schmitz said the
permit would have to allow for hook up to sewer.  Attorney Parmentier
stated the ordinance change either needed to be denied by the Town
Board or if amended, needed to be reviewed by the Planning Committee. 
Chairman Giese felt this change warranted a Public Hearing especially
for those in subdivisions to review.  The recommendation was made to
refer the matter to the Planning Committee.
There have been several individuals who would like to volunteer to do
some work in the Town.  In order to protect the Town, the
recommendation was made to provide a Volunteer Hold Harmless Agreement
for the volunteers to sign.  Motion was made and seconded to approve
the Volunteer Hold Harmless Agreement.  Motion carried.
Van Horn has submitted a frontage road proposal to the County for
approval per the 2002 agreement with the Town.  The Town Board agrees
with the location and recommends the County move forward with the
request.
Clerk Supple noted that Engineer Mikkeljahn had requested a copy of
the bidding specs for the Town.  He will be getting bids on a 40X 100
heated storage building.  Mrs. John Zeleske asked why the building
needed to be so large.  Supervisor L. Schmitz stated it was projected
to be used for 20 years and that size would be needed for storage.
Motion was made and seconded to approve the sale of the Fire
Department Pumper Truck for $24, 930.00.  Motion carried.  The money
will be added to the Fire Department Equipment fund.
Amy Wenzel of W6901 Rogersville Road has four dogs and is requesting a
kennel license.  In this area, the zoning would require a SUP for a
kennel.  After discussion, it was determined Ms. Wenzel needed to
license the two dogs that she would be keeping.  The two dogs she
plans to sell or give away in the near future would not need to be
licensed.
Supervisor L. Schmitz will attend the Highway Committee meeting.
There are no Board of Appeals Meetings planned.  The Planning
Committee will be scheduling meetings to review the Camping ordinance
and the Fondy Sports Complex Aqua Park application.
On August 3, 2015 at 9:30 am the Judge will rule on the overdue
personal property taxes that the Town has tried to collect. 
Supervisor L. Schmitz will attend the hearing.
Clerk Supple reported the new voting machines have been ordered by the
County Clerk Lisa Freiberg and will be used in the 2016 elections. 
Poll workers, Chief Inspectors and the Clerks will be trained on the
use of the new machines.

Motion was made and seconded to approve the Financial Report.  Motion
carried.
PAYMENT OF BILLS: 
Bills:  $193,081.90  Wages:  $12,249.69
Motion was made and seconded to approve the Payment of Bills.  Motion
carried.
The Town Board intends to convene into closed session pursuant to Wis.
Stat. § 19.85(1)(g) for the purpose of conferring with legal counsel
for the Town who is rendering oral or written advice concerning
strategy in litigation in which the Town is or is likely to become
involved and pursuant to Wis. Stat. § 19.85(1)(e) for the purpose of
deliberating or negotiating the purchasing of public properties, the
investing of public funds, or conducting other specified public
business, because bargaining reasons require a closed session. In
closed session, the Board will be discussing the lawsuit against John
Zeleske and potential litigation concerning property located at W5194
Bechaud Beach Drive (roll call vote required). By roll call vote, L.
Schmitz aye, D. Schmitz aye and B. Giese aye.  The Board adjourned
into closed session.
After the closed session, motion was made and seconded to adjourn. 
Motion carried.
