PUBLIC HEARING
NOVEMBER 10, 2014
7:00 PM
The Public Hearing concerning the updated Farmland Preservation
ordinance was called to order by Chairman Robert Giese.  The Hearing
is to present the amended zoning ordinance and map as certified by the
Wisconsin Department of Trade and Consumer Protection.  Attorney Matt
Parmentier stated the ordinance and map was updated to conform to the
State Statutes.  These updates were an ongoing process over the last 3
years.  Workshops were held and letters sent to owners of agricultural
properties.  After much review, the final draft was sent to the State
for review and approval.  Final approval was recently received, and
will allow eligible farmers to collect the tax credit through 2024.  
John Dux stated he is not concerned about the change in the ordinance
since it provides for farmers to receive tax credits, however he was
upset about the entire Town being rezoned during this process. 
Attorney Parmentier stated the Town-wide rezone was not necessarily
required in all cases.  However, the Town of Fond du Lac map must
conform to the County map in respect to agricultural and
non-agricultural zoning.  Certification approval from the State relies
on the County and Town maps matching.  Mr. Dux went on to express
concern over the rezoning along Highway 23 to Commercial zoning.  He
stated this rezoned is premature.  He noted much of the rezoned land
is still being farmed.  Per the Right to Farm Act, no matter what the
zoning, the land can still be farmed as long as it meets the farming
rules.  John Zeleske asked if the approved map was consistent with the
map from last November.  Mr. Zeleske again asked for his property to
remain zoned agricultural.  Attorney Parmentier reiterated the zoning
on the Town map must be consistent with the County map.  If not
consistent, the Town’s farmers would lose eligibility for tax credits.
 Mr. Zeleske asked for a copy of the letter from the Town denying his
zoning request.  Mr. Dux noted the farm eligibility requires certain
financial income and consistent farm use.
There being no more comments, motion was made and seconded to adjourn
to the Monthly Meeting.  Motion carried.
MONTHLY MEETING
The Monthly Meeting was called to order by Chairman Robert Giese. 
Present were Chairman Giese, Supervisor LeRoy Schmitz, Clerk Patti
Supple, Treasurer Jody Roffers, Attorney Matt Parmentier and various
Town residents.  Confirmation was made of open meeting notice. 
Minutes from the previous meeting were approved as presented.
There were no public comments.
Chairman Giese requested permission to take agenda item #10 concerning
the sale of packaged alcoholic beverages out of order.  At the October
meeting, the owners of East Shore Minute Mart requested the Town of
Fond du Lac change the ordinance for alcoholic package goods to
reflect the State of Wisconsin hours revised in 2007.  At the present
time, The Town Ordinance limits sales to between the hours of 8:00 am
and 9:00 pm.  The State hours are 6:00 am to midnight for beer and
6:00 am to 9:00pm for alcohol.   Owners of the Mini Mart and Hwy 151
Mobil station were present to request the change in order to compete
with surrounding Townships and their extended hours.  After
discussion, motion was made and seconded to adopt the State hours for
liquor sales as noted above.  Motion carried.
Jim Supple, Code Enforcement, presented his report.  
a.	 The Zeleske shed litigation brief is due by December 15.  The
Board will meet in closed session.
b.	Bob Welling should be incarcerated due to non-compliance on his
court mandated sewer and water hookups.
c.	Paul Gabel on Brown Road did foundation work without a permit.  He
was notified of the violation and obtained the required permit.
d.	Mr. Torres called Chairman Giese concerning his ongoing drainage
complaints.  Chairman Giese contacted the County, DNR and Town
Building Inspector.  All found no violations on the part of Mr.
Torres’ neighbor.  Mr. Torres is still not satisfied.
Arthur Aigner owner of the property on CTH OOO has submitted a CSM and
request for a Special Use Permit.  He would like to sell @ 2 acres of
land to Riese Tree Service.  Mr. Riese would like to construct a 40 X
60 storage building for his tree trimming equipment.  The Planning
Committee has reviewed this request and established the following
requirements for the SUP.  All set-backs must be met, a site and
drainage plan provided to the County for review, 3000 sq.ft. maximum
for the building, all equipment needs to be under cover or behind a
solid fence, the SUP is non-transferable, and all required building
permits be obtained. After review, motion was made and seconded to
approve the CSM and Special Use Permit.  Motion carried.
Motion was made and seconded to amend the Farmland Preservation Zoning
Ordinance and Map as certified by the Wisconsin Department of
Agriculture, Trade and Consumer Protection.  Motion carried.
The owners of property at W6764 and W6770 Osage Court have agreed to a
culvert maintenance agreement.  Mr. Kinzinger has signed and returned
the agreement, but Mr. Schultz has not signed as yet. 
Due to incomplete road work in Westfield Hideaway Subdivision, it was
decided by the Town Board and legal counsel that the present and
future property owners be notified of the developer not completing the
roads, and the potential financial liability on property owners within
the subdivision.  Motion was made and seconded to approve the
Resolution putting on the title the potential liability.  Motion
carried.
A meeting will be held on November 13, 2014 concerning the frontage
road access off Esterbrook Road onto the Van Horn property.
Per an email from Scott Roltgen, there is still not a unanimous
consensus for the upgrade of Emery Lane.
The letter of credit for Fondy Investments was received on November 7,
2014 and is valid through October 30, 2015.
The Premier Streblow Lane Estates II development agreement was
approved on October 13, 2014 and is awaiting final signatures.  Andy
Klemp from Gremmer & Associates has done the engineering reviews. 
Motion was made and seconded to have Gremmer do the review of the
utility plans.  Motion carried.
Some work has not been correctly completed in Esterbrook Estates
Addition 1.  Also, the punch list needs to be completed.  Hometown
Bank would like the Town to take over responsibility for the roads as
soon as possible.  Gremmer will be meeting with Hometown’s engineer
concerning resolving the final issues.
The topic for Stormwater is Sidewalk and parking lot maintenance.  Jim
Supple has updated the outfalls with AECOM by adding three more
outfalls.  The fall inspection has been completed and reports will be
forwarded to Attorney Parmentier for addition to the MS-4 permit.
The Shoreland Zoning Agreement with Fond du Lac County was discussed. 
In order to maintain farmland preservation approval and review over
Shoreland areas, an agreement with the County is required.  Motion was
made and seconded to approve the Shoreland Zoning Agreement with Fond
du Lac County.  Motion carried.
The owners of Fondy Sports were present to request review of their
proposal for an Aqua park.  Due to many questions concerning the
proposal, it was recommended to meet at a workshop meeting to discuss
the proposal and then the Town Board will convene into a closed
session for more discussion.  The owners of the Sports Park wanted to
inform the Town Board that they feel this is a low level of
development that will add much needed attraction to the Sports Park. 
In addition, once the reimbursement/development agreement and
financial issues are agree upon, the Planning Commission will need to
review the proposal.  A date will be set once the paperwork is
submitted, fees paid and agreement is signed.
After review of the weight limits for farm implements and the
recommendation by the Town’s Association, motion was made and seconded
to approve the Ordinance Establishing Category B Implements of
Husbandry Weight Limits to be consistent with State and County
requirements.  Motion carried.
Motion was made and seconded to approve the revised amendment to the
project schedule for Premier Streblow Estates.  Motion carried.
Motion was made and seconded to approve the meter easement crossing
from Phase I and Phase II of Premier Streblow Estates.  Motion
carried.
Supervisor Schmitz attended the Highway Department meeting.  Treasurer
Roffers attended the County Treasurers meeting concerning the new tax
system
There no meetings scheduled for either the Board of Appeals or
Planning Commission.
Chairman Giese discussed a list of roads that will need repair in the
coming year.  He also recommended the Fire Department make sure they
list the old fire truck for sale as soon as the new truck is
delivered.  Due to limited space, the old truck will need to be sold
as soon as possible.
Clerk Supple reported on an @ 2 acre parcel on Rienzi Road that is
being annexed to the City of Fond du Lac.
Clerk Supple also reported with great sadness the death of Poll Worker
Joanne Steenburg.   Joanne was a loyal worker at election time.  She
was also sad to report that long time Election Inspector Cathy
Streblow has resigned her position.  Cathy has been a loyal election
worker for the Town.  Her help will be greatly missed.
Supervisor Schmitz reported the flag at Simon Park is missing. 
Roadman Schmidt went to the Park to look for the flag, but it wasn’t
found.  The rope was split and the hooks and flag were missing.

Motion was made and seconded to approve the Financial Report.  Motion
carried.

Motion was made and seconded to approve the Payment of Bills.  Motion
carried.
