MONTHLY MEETING
JANUARY 13, 2014
7:00 PM

The Monthly Meeting was called to order by Acting Chairman LeRoy
Schmitz.  Present were Acting Chairman Schmitz, Supervisor Phyllis
Giese, Clerk Patti Supple, Treasurer Jody Roffers, Attorney John St.
Peter and various Town residents.  Confirmation was made of open
meeting notice.  Minutes from the previous meeting were approved as
presented.

Tim Mengert asked for the protocol for replacing the late Chairman
Harold Manske.  The Board has several options, appoint a replacement,
call for a special election, or ask for candidates to submit their
applications.  There is no time limit for replacement, but it must be
done at a public hearing.

John Zeleske asked when the zoning changes were going into effect.  
The zoning map has been reviewed and all paperwork will be submitted
to the State of Wisconsin for approval in the near future.  Since
there have been a lack of consistency in communications between Mr.
Zeleske’s attorney and himself, Attorney St. Peter told Mr. Zeleske to
send a letter to the Clerk delineating who should be handling the
correspondence with the Town.  

Loretta Koenigs asked to whom Rocky Schmidt was reporting.  The Clerk
noted that Rocky has been keeping her informed of the plowing schedule
and other concerns which she passes on to the rest of the Board.

Tony Koenigs noted it would be nice to get some younger residents
involved with the local government and the volunteer Fire Department. 
He recommended asking for applications on the Town website.

Mike Gannon, County Representative, noted he is up for re-election in
April and has opposition.  He asked for the support of the Town of
Fond du Lac residents.

Jim Supple presented his code enforcement update:
1.	 Woodland Mobile Home Park is in foreclosure proceedings.  Attorney
Robert Carrol noted the mobile home that has been abandoned in the
park will hopefully be removed or repaired once ownership is
established.  Septic issues have been referred to the State by the
County Code Enforcement.  Attorney St. Peter expressed concern over
possible health and safety issues.
2.	Mr. Zeleske reported the 20 by 30 portable structure has not been
removed from his property since it is not a building per the Town
Ordinances.  Since this matter has not been resolved, the Town has
authorized Attorney St. Peter to begin judicial proceedings.
3.	Snow that was being plowed across Streblow Drive by the snow plow
driver for the Community Church has been removed.
4.	An issue of dog excrement on private property was determined to be
a matter between neighbors and not a Town Board issue.
Kaempfer and Associates provided change orders for time extensions due
to unseasonable weather conditions.  Motion was made and seconded to
approve the following change orders:  CO-107130A-04, CO-1071301-B-04,
and CO-1071303C-04 concerning the electrical, mechanical, heating and
landscaping change order time extensions.  Motion carried.

The status report was provided.  It was requested the status report be
sent the week prior to the Monthly Meeting to allow for more time to
review.

The proposed amendment to the Town/Village water maintenance agreement
to allow for the “exercising” of the valves would cost about $2793.27
per annum.  If these valves are not used, they will eventually corrode
and break.  It was recommended to add this to the April agenda for
review and possible action.  Since the Village does fire flow flushing
could the valves be exercises at the same time??

Attorney St. Peter reported the Premier Streblow Estates, LLC
Development Agreement terms are acceptable except for the meter issue.
 Kaempfer & Associates has recommended another meter be added to help
assess the flow in the event of a line break.  During discussion, it
was determined the flow could be checked and verified by comparing
meter readings with the master meter in place.  Tom Woods noted the
State reviews and approves the engineering plans for the sewer and
water.  At issue as yet are the hydrant locations-per Town Fire
Department recommendations.  All buildings will be have sprinklers. 
The site plans are ok with some cosmetic changes addressed, as are the
grading and drainage.  The erosion control and stormwater plans are
approved.  Still needed or needing resolve are the meter going into
the buildings, final recommendations from Gremmer addressed and all
exhibits needing completion.  Motion was made and seconded to
conditionally approve the Premier Streblow Estates, LLC Phase 1
Development Agreement per Gremmer recommendations being addressed,
completion of all exhibits, reimbursement of all pertinent fees, and
to address the metering issue by providing metering numbers when
requested.  (Not to exceed more than one request quarterly, unless
problems are found.)  Motion carried.

Fondy Investments, LLC has agreed to provide reimbursement for all
pertinent fees.  The Master Development Agreement and signature pages
have been signed.  The letter of credit has been approved and a final
copy will be provided to the Town.  The County will sign the CSM once
the reimbursement check has been received by the Town. The quotes for
inspections from Kaempfer and Gremmer were reviewed.  It was noted
that Eric Otte will provide as built data for Fondy Investments. 
Motion was made and seconded to approve Gremmer & Associates as
inspector for the Town.  Motion carried.

Fondy Sports Aqua Park has still not agreed to reimburse the Town for
engineering and attorney fees.  Without this reimbursement, the Town
will not proceed with any more reviews of the aqua park.

The Gremmer & Associates scope of services letter from 1/18/2014 for
Esterbrook Estates Addition 1 needs to have justification of services
delineated before forwarding to Hometown Bank.  Motion was made and
seconded to have Gremmer update the scope of services letter and have
Attorney St. Peter forward the update to the Bank.  Motion carried.
Motion was made and seconded to approve the operator’s license for Kim
Gray, Aldi’s once payment is received.  Motion carried.  

Motion was made and seconded to approve the Stephen Strong CSM on CTH
D.  Motion carried.

Motion was made and seconded to approve the James Roberts CSM on CTH
T-the former James Alonzo property.  Motion carried.

The topic for Stormwater Management was Household Hazardous Waste.

Supervisor Schmitz attended the County Highway meeting.  He noted the
State wants lights on the roundabouts proposed for CTH V.  Supervisor
Giese will attend the OSG meeting on Thursday.

The Board of Appeals and Planning Commission have no meetings
scheduled.

Several complaints were received about the poor condition of the flag
at Simon Park.  Dave Schmitz will replace the flag.  Clerk Supple
noted the roads in Stillwater Estates and the Industrial Park have had
final asphalt added.  Supervisor Schmitz read a letter commending the
action of the Town volunteer Fire Department in the recent fire in
Ripon.

Motion was made and seconded to approve the Financial Report.  Motion
carried.

Motion was made and seconded to approve the Payment of Bills.  Motion
carried.
